The U.S. Court of Appeals for the Fourth Circuit heard oral arguments today in a lawsuit challenging North Carolina’s Senate Bill 2. This legislation, otherwise known as the “Magistrate Bill,” is the 2015 law that allows magistrates and registers of deeds employees to recuse themselves from performing duties related to marriages due to a sincerely held religious belief.
The plaintiffs in the case are appealing a decision in September 2016 by a U.S. District Court that dismissed the case because the plaintiffs lacked standing. If the Fourth Circuit overturns this decision, the case likely will return to the District Court for another hearing.
