Healthcare Opt-Out Heads to Governor

On Tuesday, the North Carolina House of Representatives voted to concur with the Senate on HB 2Protect Health Care Freedom, giving the bill final approval and sending it to the Governor’s desk.
The bill, unless vetoed by the Governor, would limit the recently passed federal health care legislation’s impact in the state by striking down the law’s controversial “individual mandate” provision, which requires citizens to purchase health insurance or face financial penalties. The bill would also require the state Attorney General to take legal action to oppose the health care legislation. Currently, there are 28 states that have filed lawsuits challenging the constitutionality of the health care law.
While the bill has been controversial and politically polarizing from the start, Governor Perdue has said that vetoing the bill is “not worth the battle,” leading many to believe that the Governor will allow HB 2 to become law without her signature.
Under North Carolina law, the Governor has 10 days to either sign or veto a bill when the General Assembly is in session. If no action is taken, the bill automatically becomes law. Should the Governor choose to veto the bill, it would be sent back to the legislature and require a three-fifths majority vote to override the veto.
